1. Provider and scope

Metadancer Images is operated by Oliver Marquardt – Business Consultant, Kleine Witschgasse 8, 50676 Cologne, Germany (“Metadancer”, “we”, “us”). These Terms govern access to and use of metadancer-images.com, customer accounts and any image licence purchased through the service.

Specific rights in an image are governed by the Metadancer Images Royalty-Free Licensing Agreement. Where that agreement and these Terms address the same subject, the Licensing Agreement prevails for the licensed image.

2. Accounts

You must provide accurate account information and keep your credentials confidential. You are responsible for activity under your account. We may suspend or close an account where there is a material breach of these Terms, suspected fraud, unlawful use or a risk to the service or third parties.

3. Catalogue and availability

Catalogue previews are for evaluation only. No licence is granted by viewing, saving to a lightbox or downloading a preview. We may correct obvious errors, withdraw an asset from future licensing or change catalogue presentation. A valid licence already granted remains subject to its terms.

4. Orders, payment and licences

Direct licensing is made available only through the purchase flow shown on the service. A licence is granted only after the applicable price has been paid and the order is confirmed. The selected S, M, L or XL tier determines the delivered file size; it does not change the legal scope of the Standard RF Licence.

Before completing a purchase, the customer will be shown the applicable price and the Licensing Agreement. The order record and licence confirmation form the evidence of the licence acquired.

5. Intellectual property

All rights, title and interest in the service, catalogue and images remain with Metadancer and/or the relevant rights holder, except for the limited rights expressly granted in the Licensing Agreement. Metadancer Images names, logos and branding may not be used without prior written permission.

6. Prohibited conduct

You must not interfere with the service, scrape or systematically extract catalogue content, bypass security measures, use previews as final content, or use any content in a way that is unlawful, infringing, misleading, defamatory or otherwise prohibited by the Licensing Agreement.

7. Liability

Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for intent, gross negligence, injury to life, body or health, or mandatory statutory liability. Subject to those mandatory rules, Metadancer is liable only as permitted by applicable law.

8. Changes and contact

We may update these Terms for future use of the service where there is a valid reason, such as a legal, technical or business change. The version presented at the time of purchase applies to that purchase. Questions can be sent to hello@metadancer-images.com.

9. Applicable law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of the country in which a consumer has habitual residence remain unaffected. Where legally permitted, Cologne, Germany is the exclusive place of jurisdiction.
